: LDW - Loss Damage Waiver
: Loss Damage Waiver (LDW) gives the renter the opportunity to
: protect themselves against financial loss in the event the
: rental car suffers damage or theft.
assuming that a) you had purchased LDW/Variable LDW, and b) you
satisfied other requirements, implicit or explicit in all related
documents, (and c) LDW is legally available), the underwriter of
LDW will offer you the opportunity to NOT pay for the losses.
the key word here is "opportunity": the wording doesn't provide
100% assurance that the underwriter will pay for the damage,
even if you are covered.
However, I would say that it is unlikely, for National NOT to
pay if you had met all the requiremnts.
: In some areas, Variable LDW is offered. This product covers the
: first $500 or $3000 in damage or loss. Any excess claim for
: damage or loss remains the Renter's responsibility.
if you had Variable LDW (due to, for example, that the rental
company substituted VLDW for LDW, or you rejected LDW in favor of
VLDW), the underwritter will pay for the first $500-$3000, and you
the rest to the extent that the damage shal exceed $500-$3000.
: LDW is subject to the terms and conditions of the rental
: contract and may not be available in all areas. LDW is not
this is the key paragraph: basically the coverage is void if
you could not satisfy the terms and conditions of the rental contract.
For example, you are probably NOT covered if a) you were speeding/
under influence/driving recklessly, etc.; b) you operated the vehicle
under faulty conditions (the brakes were failing and you knew it, but
still kept driving); c) a thirdparty not covered by the rental contract
was operating the vehicle; d) you operated the vehicle outside a
geographic area covered by the contract; .....
You really need to go back to read the rental contract and see
a) what did you buy (LDW or VLDW, if anything);
b) what are the terms and conditions of the contract;
c) do you have a story, in light of the terms and conditions in b)?
d) is the LDW/VLDW a secondary policy? in other words, does it payout
AFTER your own insurance policy?
